The writ is a common law writ issued by a higher court to an authority or lower court commanding the official(s) to produce a person who is incarcerated and to give good cause why the person who is incarcerated should not be freed, or whatever sentence imposed should not be vacated or reduced.



Its used to release prisoners who are charged with crimes that are either not crimes, or have been wrongfully convicted under state or federal law.



It is also used by people who are held against their will in psychiatric hospitals, nursing homes and anywhere else where they are involuntarily committed.

What you were asking about is: writ of habeas corpus, requires that a person be brought before a court or judge to determine if they can be legally jailed or are to be set free.
